This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that requires publishing the rules and regulations and the EULA for access or usage of the website privacy policy and Terms of Use for access or usage of the website www.ssbiz.in (mentioned as ‘ssbiz‘/’application’/’we’, ‘us’ /’Company’ hereon).
  • The domain name ssbiz.in (hereinafter referred to as “Website”) is owned by Shivshakti Home Services Biz Limited, registered under the Company’s Act,1956 having its registered office at 7,8,9 Dada Complex-2, Near Dena Bank, Naliya, Kachchh, Gujarat-370655 also the Head Office is located at A/3, Meeraj Apartments, Opp. Reliance Trends Mall, Natubhai Circle, Racecourse Circle(W), Vadodara-390007. The terms and conditions set forth below (“Terms of Use”) and the Privacy Policy (as defined below) constitute a legally-binding agreement between Shivshakti Home Services Biz Limited (‘ssbiz’), and you. These Terms of Use contain provisions that define your limits, legal rights and obligations with respect to your use of and participation in (i) the ‘ssbiz’ website and mobile application, including the classified advertisements, forums, various email functions and Internet links, and all content and ‘ssbiz’ services available through the domain and sub-domains of ‘ssbiz’ located at www.ssbiz.in (collectively referred to herein as the “Website”), and (ii) the online transactions between those users of the Website who are offering services (each, a “Service Provider”) and those users of the Website who are obtaining services (each, a “Service User”) through the Website. The Terms of Use described below incorporate the Privacy Policy and apply to all users of the Website, including users who are also contributors of video content, information, private and public messages, advertisements, and other materials or Services on the Website.
  • You acknowledge that the Website serves as a venue for the online distribution and publication of user submitted services between Service Providers and Service Users, and, by using, visiting, registering for, and/or otherwise participating in this Website, including the Services presented, promoted, and displayed on the Website, and by clicking on “I have read and agree to the terms of use,” you hereby certify that: (1) you are either a Service Provider or a prospective Service User, (2) you have the authority to enter into these Terms of Use, (3) you authorize the transfer of payment for Services requested through the use of the Website, and (4) you agree to be bound by all terms and conditions of these Terms of Use and any other documents incorporated by reference herein.   • This application is an aggregator platform for various services and enables the connection between individuals seeking to obtain services and/or individuals seeking to provide services. ‘ssbiz’ Customers are hereinafter referred to as “Users” and individually as “User”. Those certain services requested by the ‘ssbiz’ Customer, which are to be completed by the ‘ssbiz’ Service Provider, are hereinafter referred to as “Services”.
  • ‘ssbiz’ does not provide the services listed and ‘ssbiz’ is not a service provider. It is a software / Technology company which enables the user to book a Service. It is solely up to the third-party Service Providers to offer the services which may be scheduled through the use of the Website or our Android / iOS/ Windows App. ‘ssbiz’ provides the information and means to obtain such third-party services, but does not and does not intend to provide the services or act in any way as a service provider and has no responsibility or liability for any services provided to you by such third parties Service Providers.
  • Please note that by availing/offering any service on this website/application, or generally browsing through this website/application, you agree to these Terms of use, privacy policy, security terms, code of conduct and any other conditions mentioned on this website/application. The term ‘you’ refers to the user or viewer of our website/application. In addition to the Content (in form of text, images) on the application, the application provides you with opportunities to submit content on the site. By using our application and posting comments on it, you accept the terms of this EULA as mentioned below. In case you choose not to agree to these terms of EULA, we advise you not to use this application.

    • 2. TERMINATION OR SUSPENSION:

    • We reserve the right to modify or amend the terms of use without notice, and your continued use of the website in any form after these changes will mean that you accept the revised terms of use.

    3. CITIES OF OPERATION:

    • The Web Site and Android / iOS Apps, as of now are offered to people residing in, and seeking/providing services, in the city of Vadodara. If you do not reside in this city or want delivery of services outside of this city, the services and products offered on the website are not meant for you for now, we will bein your area shortly. For now you can use online payment services, which does not require physical delivery to your address.

    4. REGISTRATION REQUIREMENTS:

    A) LICENSE TO ACCESS:

    • ‘ssbiz’ hereby grants you a non-exclusive, revocable license to use the Website as set forth in the Terms of Use; provided, however, that (i) you will not copy, distribute, or make derivative works of the Website in any medium without ‘ssbiz’ prior written consent; (ii) you will not alter or modify any part of the Website other than as may be reasonably necessary to use the Website for its intended purposes; and (iii) you will otherwise act in accordance with the terms and conditions of the Terms of Use and in accordance with all applicable laws.
    B) ACCOUNT POLICIES:
    • User / users means any individual or business entity or organization that legally operates in India or in other countries, uses and has the right to use the Services provided by‘ssbiz’. You must create an account on www.ssbiz.in to request/offer service. Please make sure that you provide complete and correct information on the registration form to enable us to serve you better.
    • You are the sole authorized user of your account. You are responsible for maintaining the confidentiality of any password and account number provided by you or ‘ssbiz’ for accessing the Service. You are solely and fully responsible for all activities that occur under your password or account. ‘ssbiz’ has no control over the use of any User's account and expressly disclaims any liability derived there from. Should you suspect that any unauthorized party may be using your password or account or you suspect any other breach of security, you will contact ‘ssbiz’ immediately.
    • You are advised not to use someone else's account for any objective at any time. It would lead to you being immediately barred from using the website. ‘ssbiz’ (www.ssbiz.in) might charge you a fine or take legal action against you for unlawfully accessing someone else's account.
    • The Services provided by ‘ssbiz’ is a technology-based service which enables the hiring of Servicemen for a home-based solution of problems in categories such as cleaning, appliances, electronics, etc, and also provide various other services through the application or website. Our Services are available only to those individuals or companies who can form legally binding contracts under the applicable law. You may access this application and it's Services only if You are 18 years of age or older and are legally capable of entering into a binding contract as per applicable law, including, in particular, the Indian Contract Act, 1872.
    • ‘ssbiz’ advises its users that while accessing the application, they must follow/abide by the related laws. We are not responsible for the possible consequences caused by your behavior during use of web site. ‘ssbiz’ may, in its sole discretion, refuse the service to anyone at any time.
    • You acknowledge and agree that you shall comply with the following policies (the "Account Policies"):
      • You will not copy or distribute any part of the Website in any medium without ‘ssbiz’ prior written authorization.
      • You will not alter or modify any part of the Website other than as may be reasonably necessary to use the Website for its intended purpose.

      • You shall not use any automated system, including but not limited to, "robots," "spiders," "offline readers," "scrapers," etc., to access the Website for any purpose without ‘ssbiz’ prior written approval.
      • You shall not in any manual or automated manner collect Service Professionals or Service Users information, including but not limited to, names, addresses, phone numbers, or email addresses, copying copyrighted text, or otherwise misuse or misappropriate Website information or content, including but not limited to, use on a "mirrored", competitive, or third party site.
      • You shall not in any way that transmits more request messages to the ‘ssbiz’ servers, or any server of a ‘ssbiz’ subsidiary or affiliate, in a given period of time than a human can reasonably produce in the same period by using a conventional online web browser; provided, however, that the operators of public search engines may use spiders or robots to copy materials from the site for the sole purpose of creating publicly available searchable indices of the materials, but not caches or archives of such material. ‘ssbiz’ reserves the right to revoke these exceptions either generally or in specific cases.
      • You shall not recruit, solicit, or contact in any form Service Professionals or Service Users for employment or contracting for a business not affiliated with ‘ssbiz’ without express written permission from ‘ssbiz’.
      • You shall not take any action that (i) unreasonably encumbers or, in ‘ssbiz’ sole discretion, may unreasonably encumber the Website's infrastructure; (ii) interferes or attempts to interfere with the proper working of the Website or any third-party participation in the Website; or (iii) bypasses ‘ssbiz’ measures that are used to prevent or restrict access to the Website.
      • You agree not to collect or harvest any personally identifiable data, including without limitation, names or other Account information, from the Website, nor to use the communication systems provided by the Website for any commercial solicitation purposes.
    C) ADDITIONAL POLICIES:
    • Your access to, use of, and participation in the Website is subject to the Terms of Use and all applicable ‘ssbiz’ regulations, guidelines and additional policies that ‘ssbiz’may set forth from time to time, including without limitation, a copyright policy and any other restrictions or limitations that ‘ssbiz’ publishes on the Website (the "Additional Policies"). You hereby agree to comply with the Additional Policies and your obligations there under at all times. You hereby acknowledge and agree that if you fail to adhere to any of the terms and conditions of this Agreement or documents referenced herein, including the Account Policies, membership eligibility criteria or Additional Policies, ‘ssbiz’, in its sole discretion, may terminate your Account at any time without prior notice to you as well as initiate appropriate legal proceedings, if necessary.

    5. USER INFORMATION:

    • ‘ssbiz’ reserves the right to collect user data including name, contact information and other details to facilitate services or use of its platform to avail services. All information collected from the user are on a bonafide basis. User accounts bearing contact number and email IDs are created and owned by ‘ssbiz’. Any promotional discounts, offers and reward points accumulated can be revoked without prior notice in the event of suspicious account activity or malafide intent of the user.
    • In the case where the system is unable to establish unique identity of the user against a valid mobile number or e-mail ID, the account shall be indefinitely suspended. ‘ssbiz’ reserves the full discretion to suspend a user's account in the above event and does not have the liability to share any account information whatsoever.
    • ‘ssbiz’ may change, modify, amend, or update this agreement from time to time without any prior notification to users and the amended and restated terms and conditions of use shall be effective immediately on posting. If you do not adhere to the changes, you must stop using the service. Your continuous use of the Services will signify your acceptance of the changed terms.

    6. SERVICE AND SERVICE PROVIDERS :

    The following Terms & Conditions shall apply to customers utilizing the Services offered by ‘ssbiz’:

    • This application is a neutral platform enabling connections between users and service providers.
    • Although we do perform background checks of service providers, we do not assume any responsibility for the accuracy or reliability of this information or any information on the Service or for the expence, ability, knowledge, quality, reliability, etc...of true service provider
    • Neither this application nor its affiliates or licensors are responsible for the conduct, whether online or offline, of any service provider of the service. The application and its affiliates and licensors will not be liable for any claim, injury or damage arising in connection with your use of the service.We would advise users to exhibit the best of their discretion while making a choice.
    • In case you have a dispute with one or more other service providers, you hereby release The Company i.e‘ssbiz’, its directors, officers, employees, executives and consultants from claims, demands and damages (actual and consequential) of every kind or nature. The application or Website or company would have no liability for any loss or damage incurring to you due to any communications or dealings with any of the service seekers, service providers, or other users on the web site.
    • We are committed to making your experience on the Web Site a helpful one. If you are a service seeker, once you put in your requirement for the service provider, the application would inform the service providers enrolled on our platform for that job.

    • You understand and agree that we make no warranties about the service seekers. While we would try our best to avoid any payment related issues, we cannot be held responsible for payments not being made by service seekers in any form, and we would not make any payments to service providers, in case service seekers fail to do so.
    • The charges mentioned on the site are for services only and doesn’t include cost for replacements/parts or spare parts/warranties/guarantees/ consumables and other supplies, if required and hence we will not entertain any disputes arising in this matter.
    • Service provider shall not use the name of Company in their personal work.
    • Service provider, alone is responsible for the quality of work/service provided. Company will not hold any warranty against the quality of service provided.
    • Service provider shall compulsorily carry their ID proof at the time of visitation to the service seeker.
    • Service provider shall not visit the work place of service seeker with any prohibited condition / items and shall not indulge in any activity or action prohibited under the law of the India. Incase of default, ‘ssbiz’ reserves the right to take legal action against the service provider.
    • We include a feedback system wherein you can give feedback and rate the service provider. We take the feedback seriously and regular offenders will be banned from Company. You agree to be fair, accurate and non disparaging while leaving comments, feedback, testimonials and reviews on or about the Website/Application, you acknowledge that You transfer all rights in such Feedback to us and that we will be free to use the same as we may find appropriate. Based on the feedback, if required, inquiry shall be automatically conducted and not on oral complains.
    • The Service may be used for your personal, non-commercial use only; you may not use the Service in connection with any commercial endeavors whatsoever without the express prior written consent of Company.
    • The customer agrees and acknowledges that the use of the Services offered by Company is at the sole risk of the customer and that Company disclaims all representations and warranties of any kind, whether express or implied as to condition, suitability, quality, merchantability and fitness for any purposes are excluded to the fullest extent permitted by law.
    • The Company makes no representation or warranty that the Services will meet the customer's requirements or will be uninterrupted, timely, secure, or error-free.
    • The Company shall not be responsible or liable for any loss or damage, howsoever caused or suffered by the Customer arising out of the use of service offered by Company or due to the failure of Company to provide Services to the Customer for any reason whatsoever including but not limited to the Customer's non-compliance with the Services' recorded instructions, malfunction, partial or total failure of any network terminal, data processing system, computer tele-transmission or telecommunications system or other circumstances whether or not beyond the control of Company or any person or any organization involved in the above mentioned systems.
    • The Company shall not be liable for any conduct of the Servicemen. However, the Company encourages you to notify it of any complaints that you may have against any Serviceman that you may have experienced using the Company's Services.
    • The Company shall be entitled to add to, vary or amend any or all these terms and conditions at any time and the Customer shall be bound by such addition, variation or amendment once such addition, variation or amendment are incorporated into these terms and conditions at Company's website at www.ssbiz.in on the date that Company may indicate that such addition, variation or amendment is to come into effect.
    • The Company has the right to use the customer's contact information for its own marketing purposes. The Company may send regular SMS updates to the mobile numbers registered with it.

    7. JURISDICTION:

    • The courts of competent jurisdiction located in Vadodara, India shall have the sole and exclusive jurisdiction in respect of any matters arising from the use of the Services offered by Company or the agreement or arrangement between Company and the Service seeker/ customer.

    8. PAYMENT POLICY:

    • The use of the Website/App and Services is free of cost. However, the charge policy can be amended at Our discretion and We reserve the right to charge for any of the Services.
    • You can either pay the Transaction Fee directly to the service provider upon completion of his/her services or through the Website/App, in Indian Rupees.
    • If You choose to pay the Transaction Fee through the Website/App, your credit/debit card or other payment instruments will be processed using a third party payment gateway (“Payment Facility”) which will also be governed by the terms and conditions agreed to between You and Your issuing bank.
    • We will not be responsible for any loss or damage to you due to your use of the Payment Facility on the Website/App.
    • We can impose limits on the number of Transactions or the Transaction Fee which We receive from You and can refuse to process any Transaction Fee, at Our sole discretion.
    • At the end of the week, all the payments will be processed by the company.
    • The standard rate for the service to be provided shall be fixed by the company and may undergo change as per the policy of the company with time and without prior notice.
    • The policy regarding commission charges or account handling charges may be updated time to time by the company. The company has no restriction for apply the policy any time.
    • The service seeker shall pay the service or labour cost, visit or transportation cost (if applicable), item cost (if applicable), convenience cost (if applicable) and any fee or levy presently payable or hereinafter imposed by the law or required to be paid for availing the Local Services.
    • Any reimbursement expenses that are incurred by a service provider in connection with the completion of a Service may, however, be paid in cash offline or through the application.
    • Service seekers are obligated to pay for the services of the Service, unless specifically notified otherwise. Company Service seekers can also pay at the end of a completed Service transaction.
    • Transactions on the website are protected by SSL (Secure Sockets Layer) and Secure Data Encryption using a 1024-bit process. Any information you enter when transacting with the webstore is sent in a Secure Socket Layer (SSL) session and is encrypted to protect you against unintentional disclosure to third parties. This is an assurance that it follows the best security practices adopted by major online vendors where all payments are processed in real-time for your security and immediate peace of mind. Credit card and Debit card information is not stored by us and is not taken by us. This information is taken directly by the payment gateway provided who is authorized and is compliant with the regulations and requirements of various banks and institutions and payment franchisees that it is associated with.

All title, ownership and intellectual property rights in the web site and its content shall remain with Company. Users may not copy, download, use, modify, alter, sell, transfer, redesign, reconfigure, or retransmit anything from the Service without Company's express prior written consent.
    • The information contained on this application is intended, solely to provide general information for personal use of the reader, who accepts full responsibility for its use. Systematic retrieval of ‘ssbiz’ content to create or compile, directly or indirectly, a collection, compilation, database or directory, whether through robots, spiders, automatic devices or manual processes without written permission from ‘ssbiz’ is prohibited.
    • In addition, use of the content for any purpose not expressly permitted in this Agreement is prohibited and may invite legal action. As a condition of your access to and use of ‘ssbiz’ Services, you agree that you will not use the service of this application to infringe the intellectual property rights of others in any way. ‘ssbiz’ reserves the right to terminate the account of a user/users upon any infringement of the rights of others in conjunction with use of the ‘ssbiz’ service, or if ‘ssbiz’ believes that user/users conduct is harmful to the interests of ‘ssbiz’, its affiliates, service providers, investors, or other users, or for any other reason in ‘ssbiz’ sole discretion, with or without cause.

    11. LIABILITY:

    • You agree not to hold ‘ssbiz’, its affiliates, its licensors, or any of such parties, agents, employees, officers, directors, corporate partners, or participants liable for any damage, suits, claims, and /orcontroversies (collectively, “liabilities”) that have arisen or may arise, whether known or unknown, relating to your use of orinability to use the service, including without limitation any liabilities arising in connection with the conduct, act or omission of any user (including without limitation stalking, harassment that is sexual or otherwise, acts of physical violence, and destruction of personal property), any dispute with any service provider, any instruction, advice, act, or service provided by ‘ssbiz’ or its affiliates or licensors and any destruction of your information.
    • Under no circumstances will ‘ssbiz’ its affiliates, its licensors, or any of such parties' agents, employees, officers, directors, corporate partners, or participants be liable for any direct, indirect, incidental, consequential, special or exemplary damages.
    • Not withstanding the foregoing exclusions, it is determined that ‘ssbiz’orits affiliates, its licensors, or any of such parties' agents, employees, officers, directors, corporate partners or participants are liable for damages, in no event will the aggregate liability, whether arising in contract, tort, strict liability or otherwise, exceed the total fees paid by you to ‘ssbiz’ during the three months prior to the time such claim arose.

    12. INDEMNIFICATION:

    • You hereby agree to indemnify, defend, and hold harmless ‘ssbiz’, its directors, investors, officers, employees, agents, licensors, attorneys, independent contractors, providers, subsidiaries, and affiliates from and against any and all claim, loss, expense or demand of liability, including attorneys' fees and costs incurred, arising from your use or inability to use the Services.

    13. RESCHEDULING POLICY:

    • To avoid cancellation charges please reschedule or cancel the order within 2 hours of booking the service.

    14. CANCELLATION POLICY:

    • Your service request may be rescheduled or cancelled anytime online through the application.
    • The cancellation charges will be Rs100 or 2%of the total order value.
    • If service request is cancelled by the service seeker within 2 hours of booking, the cancellation charges will NOT be applicable. If the service is cancelled after this, customer is liable to pay the cancellation charges
    • If the service is cancelled from ‘ssbiz’ end, then the cancellation charges will NOT be applicable
    • Due to any unforeseen circumstances or internal reasons, ‘ssbiz’ reserves the right to cancel any order at any point of time, and will not be liable to anyone for the same.
    • If the visit is cancelled by the service Provider then customer is NOT liable to pay cancellation charges.
    • The service provider has mark on his side of application to attend response when an inquire is made within company time line for acceptance. If he is not willing to accept any work during that period of time, he is required to show himself offline by turning the mark off so that no work is allotted to him and is allotted to some other service provider.

    15. PUBLIC AREAS:

    • This application and its website may contain profiles, email systems, message boards, applications, job postings, forums or blogs will be available in regards to the application on website like Facebook or other social network websites and the other message or communication facilities available is called “Public Areas” that allow Users to communicate with other Users. You may only use such community areas to send and receive messages and material that are relevant and proper to the applicable forum.
    • Without limitation, you may not:
      • Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights of others.
      • Impersonate another person or allow any other person or entity to use your identification to post or view comments.
      • Use the Service for any purpose which is in violation of local, state, national, or international laws.
      • Publish, post, upload, distribute or disseminate any profane, defamatory, infringing, obscene or unlawful topic, name, material or information.
      • Upload files that contain software or other material that violates the intellectual property rights or rights of privacy of any third party.
      • Upload content that is offensive and/or harmful, including, but not limited to, content that advocates, endorses, condones or promotes racism, bigotry, hatred or physical harm of any kind against any individual or group of individuals.
      • Advertise or offer to sell any goods or services for any commercial purpose on the Service which are not relevant to the services offered on the Service.
      • Conduct or forward surveys, contests, pyramid schemes, or chain letters.
      • Upload files that contain viruses, Trojan horses, corrupted files, or any other similar software that may damage the operation of another's computer.
      • Post the same note repeatedly referred to as 'spamming'. Spamming is strictly prohibited.
      • Download any file posted by another User that a User knows, or reasonably should know, cannot be legally distributed through the Service.
      • Restrict or inhibit any other User from using and enjoying the Public Areas.
      • Imply or state that any statements you make are endorsed by ‘ssbiz’, without the prior written consent of ‘ssbiz’.
      • Use a robot, spider, manual and/or automatic processes or devices to data-mine, data- crawl, scrape or index ‘ssbiz’ in any manner.
      • Hack or interfere with ‘ssbiz’(www.ssbiz.in), its servers or any connected networks.
      • Adapt, alter, license, sublicense or translate ‘ssbiz’(www.ssbiz.in) for your own personal or commercial use.
      • Remove or alter, visually or otherwise, any copyrights, trademarks or proprietary marks and rights owned by ‘ssbiz’(www.ssbiz.in).
      • Upload content that provides materials or access to materials that exploit people under the age of 18years in an abusive, violent or sexual manner.

    16. USER CONTENT:

    A) PERMISSION TO USE:

    • In case you submit any content on the website (included but not limited to photographs and text) you grant us permission to use, reproduce, display, distribute and promote such content in any form, and media. However, as mentioned in the Privacy Policy, your personal details would not be made available in public domain without your prior permission.
